READ THIS DOCUMENT CAREFULLY BEFORE INSTALLING THIS SOFTWARE. BY DOWNLOADING, INSTALLING AND USING THIS SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT INSTALL OR USE THE SOFTWARE. YOU AGREE THAT YOUR INSTALLING OR USE OF THE SOFTWARE ACKNOWLEDGES THAT YOU HAVE READ THIS LICENSE, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.

This is a legal agreement between you (either an individual or an entity) and ZIPmagic Computing, Inc., and its suppliers and licensors (collectively "ZIPmagic Computing, Inc.").  This Agreement states the terms and conditions upon which ZIPmagic Computing, Inc. offers to license the ZIPmagic software, together with all related documentation and accompanying items including, but not limited to, the executable programs, drivers, libraries and data files associated with such programs (collectively, the "Software").

You acknowledge that you are in possession of proprietary and confidential trade secret materials belonging to ZIPmagic Computing, Inc. or its licensors. Except as provided herein, all information and materials provided to you shall be considered "Confidential Information".  You promise not to use, disclose or otherwise disseminate any Confidential Information without the express written consent of ZIPmagic Computing, Inc. Confidential Information does not include information: (i) was already known to you prior to receipt from ZIPmagic Computing, Inc.; (ii) is or becomes public knowledge without breach of your obligations under this Agreement; (iii) is rightfully acquired by you from a third party without restriction on disclosure or use; (iv) was or is disclosed by the ZIPmagic Computing, Inc. to a third party prior to or after the date of this Agreement without restriction or use; (v) is independently developed by you without resort to ZIPmagic Computing, Inc.'s disclosure; or (vi) is disclosed or used following your receipt of express written consent from an officer of ZIPmagic Computing, Inc. Provided, however, that you shall have the burden of proof respecting any of these events on which you rely as relieving you of any restrictions under this Agreement. In addition, prior to any disclosure or use of Confidential Information pursuant to this paragraph, you must first notify ZIPmagic Computing, Inc., in writing, of the specific Confidential Information you seeks to use or disclose pursuant to this paragraph, and the factual and/or legal reasons therefore. Said written notice shall be made at least two weeks before using or disclosing such Confidential Information. You promise to act diligently in keeping their trade secrets and other confidential materials secret. You promise to act consistently with the legal requirements to maintain the "trade secret" classification of ZIPmagic Computing, Inc.'s confidential business information.  

1. Grant of License
The Software is not sold to you. Rather, it is licensed on a non-exclusive basis solely for use by you, and you alone, under the terms of this Agreement. ZIPmagic Computing, Inc. (and, to the extent applicable, its licensors), retains all title to and ownership of the Software and reserves all rights not expressly granted to you hereby. ZIPmagic Computing, Inc. grants you a non-exclusive, non-transferable license to use the program with which this license is distributed (the "ZIPmagic" program), including any documentation files accompanying the Software ("User Guide") on a single server (if the Software is server based) or personal computer to support up to the number of simultaneous users for which you have paid the license fee, and to make one backup copy of the Software, provided that: (i) the Software is installed on only one server or personal computer; (ii) the Software is NOT modified; (iii) all copyright notices are maintained on the Software; and (iv) you agree to be bound by the terms of this License Agreement. The Software and Documentation shall be used only by you, only for your own personal or internal business use and not in the operation of a service bureau or for the benefit of any other person or entity. 

2. Ownership 
You have no ownership rights in the Software. Rather, you have a license to use the Software as long as this License Agreement remains in full force and effect. Ownership of the Software, Documentation and all intellectual property rights therein shall remain at all times with ZIPmagic Computing, Inc. Any other use of the Software by any person, business, corporation, government organization or any other entity is strictly forbidden and is a violation of this License Agreement. 

3. No Trademark License
No license is granted to you in this Agreement, either expressly or implicitly, to use any trademark, service mark, names, or logos of ZIPmagic Computing, Inc. ZIPmagic Computing, Inc. owns all customer data collected through the registration process.

4. Copyright and Patent
The Software and Documentation contain material that is protected by United States Copyright Law, United States Patent Law, trade secret law, and by international treaty provisions. All rights not granted to you herein are expressly reserved by ZIPmagic Computing, Inc. You may not remove any proprietary notice of ZIPmagic Computing, Inc. from any copy of the Software or Documentation. 

5. Restrictions 
You may not publish, display, disclose, rent, lease, modify, loan, distribute, or create derivative works based on the Software or any part thereof. You may not reverse engineer, decompile, translate, adapt, or disassemble the Software, nor shall you attempt to create the source code from the object code for the Software. You may not transmit the Software over any network or between any devices, although you may use the Software to make such transmissions of other materials. You may transfer the Software to other computers you own as long as you only use it on one computer at a time. 

6. No Merger or Integration
You may not merge any portion of the Software into, or integrate any portion of the Software with, any other program, except to the extent expressly permitted by the laws of the jurisdiction where you are located.  Any portion of the Software merged into or integrated with another program, if any, will continue to be subject to the terms and conditions of this Agreement, and you must reproduce on the merged or integrated portion all copyright and other proprietary rights notices included in the originals of the Software.

7. No Transfer of License
You may not transfer your license of the Software to anyone.

8. Limitations on Using, Copying, and Modifying the Software
Except to the extent expressly permitted by this Agreement or by the laws of the jurisdiction where you acquired the Software, you may not use, copy or modify the Software.  Nor may you sub-license any of your rights under this Agreement. 

9. Decompiling, Disassembling, or Reverse Engineering
You acknowledge that the Software contains trade secrets and other proprietary information of InstallAware Software Corporation and/or its licensors.  Except to the extent expressly permitted by this Agreement or by the laws of the jurisdiction where you are located, you may not decompile, disassemble or otherwise reverse engineer the software, or engage in any other activities to obtain underlying information that is not visible to the user in connection with normal use of the Software.  

In particular, you agree not for any purpose to transmit the Software or display the Software's object code on any computer screen or to make any hardcopy memory dumps of the Software's object code.  If you believe you require information related to the interoperability of the Software with other programs, you shall not decompile or disassemble the Software to obtain such information, and you agree to request such information from ZIPmagic Computing, Inc. Upon receiving such a request, ZIPmagic Computing, Inc. shall determine whether you require such information for a legitimate purpose and, if so, ZIPmagic Computing, Inc. will provide such information to you within a reasonable time and on reasonable conditions.

In any event, you will notify ZIPmagic Computing, Inc. of any information derived from reverse engineering or such other activities, and the results thereof will constitute the confidential information of ZIPmagic Computing, Inc. that may be used only in connection with the Software.

10. Updates and Auto-updating
This license does not grant you any right to any enhancements or updates to the Software, nor any support services.  

11. Confidentiality 
You acknowledge that the Software contains proprietary trade secrets of ZIPmagic Computing, Inc. and you hereby agree to maintain the confidentiality of the Software using at least as great a degree of care as you use to maintain the confidentiality of your own most confidential information. You agree to reasonably communicate the terms and conditions of this Software License Agreement to those persons employed by you who come into contact with the Software, and to use reasonable best efforts to ensure their compliance with such terms and conditions, including, without limitation, not knowingly permitting such persons to use any portion of the Program for the purpose of deriving the source code of the Program or defeating the Key. 

12. Limited Warranty
ZIPmagic Computing, Inc. DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF MALICIOUS CODE. FOR PURPOSES OF THIS PARAGRAPH, "MALICIOUS CODE" MEANS ANY PROGRAM CODE DESIGNED TO CONTAMINATE OTHER COMPUTER PROGRAMS OR COMPUTER DATA, CONSUME COMPUTER RESOURCES, MODIFY, DESTROY, RECORD, OR TRANSMIT DATA, OR IN SOME OTHER FASHION USURP THE NORMAL OPERATION OF THE COMPUTER, COMPUTER SYSTEM, OR COMPUTER NETWORK, INCLUDING VIRUSES, TROJAN HORSES, DROPPERS, WORMS, LOGIC BOMBS, AND THE LIKE. IN ANY EVENT, YOUR EXCLUSIVE REMEDY, AND ZIPmagic Computing, Inc.'S SOLE OBLIGATION UNDER THIS WARRANTY, SHALL BE, AT ZIPmagic Computing, Inc.'S SOLE DISCRETION, CORRECTION OF THE DEFECT OR REFUND OF THE PURCHASE PRICE PAID FOR THE SOFTWARE. ANY USE OF THE SOFTWARE IS AT YOUR OWN RISK. THIS LIMITED WARRANTY IS THE ONLY WARRANTY PROVIDED BY ZIPmagic Computing, Inc. REGARDING THE SOFTWARE. EXCEPT FOR THE LIMITED WARRANTY ABOVE, THE SOFTWARE IS PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZIPmagic Computing, Inc. DISCLAIMS ALL OTHER WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ZIPmagic Computing, Inc. DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET ANY REQUIREMENTS OR NEEDS YOU MAY HAVE, OR THAT THE SOFTWARE WILL OPERATE ERROR FREE, OR IN AN UNINTERRUPTED FASHION, OR THAT ANY DEFECTS OR ERRORS IN THE SOFTWARE WILL BE CORRECTED, OR THAT THE SOFTWARE IS COMPATIBLE WITH ANY PARTICULAR PLATFORM. SOME JURISDICTIONS DO NOT ALLOW THE WAIVER OR EXCLUSION OF IMPLIED WARRANTIES SO THEY MAY NOT APPLY TO YOU.

FURTHER, ZIPmagic Computing, Inc. SHALL NOT BE LIABLE FOR THE ACCURACY OF ANY INFORMATION PROVIDED BY ZIPmagic Computing, Inc. OR THIRD-PARTY TECHNICAL SUPPORT PERSONNEL, OR ANY DAMAGES CAUSED, EITHER DIRECTLY OR INDIRECTLY, BY ACTS TAKEN OR OMISSIONS MADE BY YOU AS A RESULT OF SUCH TECHNICAL SUPPORT.  

YOU ASSUME FULL RESPONSIBILITY FOR THE SELECTION OF THE SOFTWARE TO ACHIEVE YOUR INTENDED RESULTS, AND FOR THE INSTALLATION, USE AND RESULTS OBTAINED FROM THE SOFTWARE.  YOU ALSO ASSUME THE ENTIRE RISK AS IT APPLIES TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE.  SHOULD THE SOFTWARE PROVE DEFECTIVE, YOU (AND NOT ZIPmagic Computing, Inc. , OR ITS DISTRIBUTORS OR DEALERS) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.

13. Limitation of Liability 
IN NO EVENT WILL ZIPmagic Computing, Inc. BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, INDIRECT, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR LOSS OF BUSINESS INFORMATION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE PROGRAM, OR FOR ANY CLAIM BY ANY OTHER PARTY, EVEN IF ZIPmagic Computing, Inc. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ZIPmagic Computing, Inc.'S AGGREGATE LIABILITY WITH RESPECT TO ITS OBLIGATIONS UNDER THIS AGREEMENT OR OTHERWISE WITH RESPECT TO THE SOFTWARE AND DOCUMENTATION OR OTHERWISE SHALL NOT EXCEED THE AMOUNT OF THE LICENSE FEE PAID BY YOU FOR THE SOFTWARE AND DOCUMENTATION. BECAUSE SOME STATES/COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. 

14. U.S. Government Restricted Rights
All Software and related documentation are provided with restricted rights.  Use, duplication or disclosure by the U.S. Government is subject to restrictions as set forth in subdivision (b)(3)(ii) of the Rights in Technical Data and Computer Software Clause at 252.227-7013. Manufacturer is ZIPmagic Computing, Inc. If you are sub-licensing or using the Software outside of the United States, you will comply with the applicable local laws of your country, U.S. export control law, and the English version of this Agreement. You are responsible for complying with all trade regulations and laws both foreign and domestic.

15. Export Restrictions 
THIS LICENSE AGREEMENT IS EXPRESSLY MADE SUBJECT TO ANY LAWS, REGULATIONS, ORDERS, OR OTHER RESTRICTIONS ON THE EXPORT FROM THE UNITED STATES OF AMERICA OF THE SOFTWARE OR INFORMATION ABOUT SUCH SOFTWARE WHICH MAY BE IMPOSED FROM TIME TO TIME BY THE GOVERNMENT OF THE UNITED STATES OF AMERICA. YOU SHALL NOT EXPORT THE SOFTWARE, DOCUMENTATION, OR INFORMATION ABOUT THE SOFTWARE AND DOCUMENTATION WITHOUT CONSENT OF ZIPmagic Computing, Inc. AND COMPLIANCE WITH SUCH LAWS, REGULATIONS, ORDERS, OR OTHER RESTRICTIONS. 

16. Termination 
This License Agreement is effective until it is terminated. You may terminate this License Agreement at any time by destroying or returning to ZIPmagic Computing, Inc. all copies of the Software and Documentation in your possession or under your control. ZIPmagic Computing, Inc. may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice. This Agreement will terminate immediately, without prior notice from ZIPmagic Computing, Inc., in the event that you fail to comply with any provision of this Agreement. Upon notification of termination, you agree to destroy or return to ZIPmagic Computing, Inc. all copies of the Software and Documentation and to certify in writing that all known copies, including backup copies, have been destroyed. All provisions relating to confidentiality, proprietary rights, and non-disclosure shall survive the termination of this Software License Agreement. 

17. Modifications to Application
ZIPmagic Computing, Inc. reserves the right to modify, suspend or discontinue, temporarily or permanently, the Application or any service to which it connects, with or without notice and without liability to you.

18. Severability
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

19. Amendments to this Agreement
ZIPmagic Computing, Inc. reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material we will provide at least 14 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

20. General 
This Agreement is binding on you as well as your employees, employers, contractors and agents, and on any successors and assignees. This License Agreement shall be construed, interpreted and governed by the laws of the United States of America without regard to conflicts of law provisions thereof. The exclusive forum for any disputes arising out of or relating to this License Agreement shall be an appropriate court sitting in Texas, United States of America. This License Agreement shall constitute the entire Agreement between the parties hereto. Any waiver or modification of this License Agreement shall only be effective if it is in writing and signed by both parties hereto. If any part of this License Agreement is found invalid or unenforceable by a court of competent jurisdiction, the remainder of this License Agreement shall be interpreted so as to reasonably effect the intention of the parties. 

21.  Injunctive Relief
You acknowledge that the Software and the Service contain ZIPmagic Computing, Inc.'s proprietary and confidential information, and that disclosure of such information or misuse of the Software will give rise to irreparable injury to ZIPmagic Computing, Inc., inadequately compensable in damages.  Accordingly, ZIPmagic Computing, Inc. may seek and obtain injunctive relief against the breach or threatened breach of the foregoing undertakings, in addition to any other legal remedies which may be available. Said relief will be available without the requirement of posting a bond or undertaking.

ZIPmagic DoubleSpace makes use of wimlib, which is Copyright (c) 2014 Eric Biggers. The version of wimlib distributed with ZIPmagic DoubleSpace is distributed under the GNU Lesser General Public License (LGPL) version 3, the terms of which can be read online at http://www.gnu.org/licenses/lgpl.html. In addition, a copy of this license will be present in the ZIPmagic DoubleSpace directory after installation.
